의정부지방법원 2025. 9. 19. 선고 2024나218801 판결(확정) 주식회사의 신주발행 후 현물출자 또는 현금납입에 따른 인수의 효력이 문제되었으나 신주발행무효의 소 제소기간 경과 등으로 이를 더이상 다툴 수 없다고 전제한 후, 해당 신주를 인수한 원고의 주주로서의 지위를 부정하고 주주명부에서 신주 소각을 반영한 내용을 등재한 회사에게는 주주명부 내용을 변경등재할 의무가 있고 원고는 이를 청구할 수 있다고 판단한 사례
